Welcome to lakebooking.com! These Terms and Conditions govern your use of our platform. Please read them carefully before making a reservation.

## Terms and Conditions (Terms of Service)

**Last Updated:** 20.10.2026

Welcome to **lakebooking.com**! These Terms and Conditions govern your use of our platform. Please read them carefully before making a reservation.

### 1. General Provisions and Definitions

- **The Platform:** The website lakebooking.com, associated mobile applications, and all related services.
- **The Operator:** The company **LakeBooking S.R.L.**, with its registered office at Strada Dr. Leonte Anastasievici, Nr. 9, Camera 2, Etaj 1, Ap. 2, Sector 5, Bucharest, postal code 050464, Romania, Sole Registration Code (CUI) 55420249, registered with the Trade Register under no. J2026049620005, email: [**contact@lakebooking.com**](mailto:contact@lakebooking.com).
- **Fisherman (User):** Any individual or legal entity who creates an account and completes a reservation through the Platform.
- **Owner (Host):** The legal administrator, manager, or owner of a fishing lake or swim listed on the Platform.
- **Fishing Experience:** A dated fishing event led by a person and sold by the place through the Platform (a masterclass, a course, a day fishing with the host, a guided trip, exclusive access to a water, a workshop or a group event), with a minimum and a maximum number of participants for each date.
- **Experience Host:** The person who lists and leads a Fishing Experience on the Platform, whether or not they own a lake, after the Operator has approved their application.
- **Booking Fee:** The platform's booking fee (currently 10% of the total booking value, subject to modification upon prior notice) collected online by the Platform for facilitating the reservation and providing our technology infrastructure. A change to the Booking Fee never applies to a booking already made.
- **Verification Status:** The "Verified" badge indicates solely that the Operator has reviewed and approved a lake listing once its setup was complete. A Host shows the same badge when a lake they operate carries it. Verification does not constitute an endorsement, certification, guarantee of quality, guarantee of safety, guarantee of legality, or recommendation by the Operator.

### 2. Legal Role of the Platform (Limitation of Liability)

- **Technological Intermediary:** LakeBooking S.R.L. acts exclusively as a technological intermediary (marketplace) connecting Fishermen with Lake Owners and Experience Hosts.
- **Nature of the Fishing Contract:** The contract for the actual fishing service is concluded directly between the Fisherman and the Lake Owner. The Operator does not own, manage, or operate the fishing lakes listed on the Platform. The Operator assumes no liability for the quality of services at the venue. The same applies to a Fishing Experience, whose contract is concluded between the participant and the Experience Host (see section 5).
- **Lakes Listed by the Operator:** A lake marked "Unclaimed listing" was added by the Operator from the information the lake publishes, and its Owner has not yet accepted the Host Agreement. For such a lake, the Operator acts on the Fisherman's behalf. It receives the request, checks availability and price with the Owner, makes the booking with the Owner on the Fisherman's behalf, and then confirms or declines it. The contract for the fishing session is still concluded between the Fisherman and the Owner. If the booking cannot be made, the Booking Fee is refunded in full.
- **Who you contract with.** Each listing shows who offers the session: the Host's name and whether the Host has declared to us that they act as a trader. When the Host is a trader, your contract with them is covered by the consumer protection law that applies to you. When a Host has declared that they are not a trader, EU consumer protection law does not apply to your contract with that Host; these Terms and the Refund Policy still apply to everything the Operator does.
- **Who is responsible for what.** The Host is responsible for the session itself: the swim, the fishing, the venue, its rules and its safety, the remaining balance and the receipt for it. The Operator is responsible for the Platform, for showing the listing and its price as the Host set them, for the booking process, for collecting and refunding the Service Fee under the Refund Policy, for the invoice for the Service Fee, and for handling complaints about the Platform. These Terms do not limit any responsibility that the Operator or the Host has under other EU or national law.
- **Niche-Specific Liability Disclaimers:** The Operator does not guarantee:
  - Fish stock levels or fish species availability.
  - Catch success or angling outcomes.
  - Weather conditions or water conditions.
  - Accessibility, lake quality, or general safety of the venue.

### 3. Financial Flow, Payments, and Invoicing

- **Price Structure:** The total price of a fishing session is transparently displayed before finalizing the reservation and consists of two parts:
  1. **Booking Fee (Online):** An amount representing currently 10% of the total (subject to modification by the Operator upon prior notice to Hosts), collected online via our secure third-party payment provider (**Stripe**).
  2. **Remaining Balance (On-site):** The remaining balance (currently 90%) which must be paid directly by the Fisherman to the Lake Owner at the venue's reception (via cash or card, according to the lake's individual policy).
- **Display Currency:** Prices may be converted to and shown in the currency the Fisherman selects whenever an exchange rate is available; otherwise they are shown in the lake's currency. The Booking Fee is charged online in the selected currency whenever an exchange rate is available, otherwise in the lake's currency. The Remaining Balance is always paid in the lake's currency (for a Fishing Experience, in the listing's currency). The currency and exact amount of each payment are shown at checkout.
- **Rounded Prices:** Prices shown while browsing (lake cards and lake pages) may be rounded up to the next whole unit of the selected currency. The price you pay is based on the exact, non-rounded amount, which is shown at checkout.
- **Invoicing:**
  - **LakeBooking S.R.L.** issues a fiscal invoice **exclusively for the Booking Fee** collected online. This invoice will be reported to the national RO e-Factura system in compliance with Romanian law.
  - **The Lake Owner** holds the exclusive legal obligation to issue a receipt or invoice for the **Remaining Balance** collected directly from the Fisherman on-site.

### 4. Cancellation, Refunds and Withdrawal

- **No right of withdrawal.** A reservation, whether for a lake session or for a Fishing Experience, is for a leisure service on a set date, so the 14-day right of withdrawal for contracts made at a distance does not apply to it (Article 16(l) of Directive 2011/83/EU and Article 16 letter l) of Government Emergency Ordinance No 34/2014; for consumers in the United Kingdom, regulation 28(1)(h) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013). The Booking Fee is part of the price of the reservation. The cancellation rules below give you more than the law requires.
- **Cancelling a lake session.** If you cancel more than 48 hours before check-in, the Booking Fee is refunded in full. If you cancel later, or do not turn up, it is not refunded. If the Owner cancels, or the swim becomes unavailable through the Owner's fault, the Booking Fee is refunded in full. The [**Refund Policy**](https://lakebooking.com/legal/refund-policy) sets out every case.
- **The remaining balance.** You pay the remaining balance only at the lake, so you owe none of it when you cancel more than 48 hours before check-in. A lake may charge a no-show fee or ask for a deposit only if its listing says so before you book.
- The cancellation and refund rules of a Fishing Experience are set out in section 5.

### 5. Fishing Experiences

- **Who you contract with:** When you book a Fishing Experience, the contract for the experience is concluded between you and the Experience Host, who organises and leads the day and is responsible for its content and its safety. The Operator intermediates the booking, collects the Booking Fee and runs the Platform; it is not the organiser of the experience. Every Experience Host agrees to the [**Experience Host Standards**](https://lakebooking.com/legal/experience-host-standards), which describe what you can expect from them.
- **Price and payment:** The listing shows the price per person and what is and is not included. The Booking Fee (section 3) is calculated on the places you book and paid online when you book; the remaining balance is paid to the Experience Host on the day, as the listing describes. While you pay, your places are held for a few minutes; a hold that is not paid in time is released.
- **Invoicing:** LakeBooking S.R.L. invoices the Booking Fee, as in section 3. The Experience Host issues the receipt or invoice their own legal status requires for the balance collected on the day.
- **Minimum number of participants:** Each date has a minimum number of paid places and a confirmation deadline set by the Experience Host and shown on the listing. If the minimum is not reached by the deadline, the date is cancelled automatically and the Booking Fee of every participant is refunded in full, unless the Experience Host chooses to run the date anyway with the participants who booked. The exact meeting point is given to paid participants once the date is confirmed.
- **Cancellation by the participant:** Each listing shows the Experience Host's cancellation window, which is 24, 48 or 72 hours, or 7 days, before the start. If you cancel at least that long before the start, the Booking Fee is refunded in full; after that, it is kept. The window that applies is the one shown when you booked.
- **Changes and cancellation by the Experience Host:** The Experience Host may move a date once, with the notice the Platform requires; every participant who booked before the move may then cancel for a full refund of the Booking Fee until the new confirmation deadline. The Experience Host may cancel a date before it starts, in which case the Booking Fee of every participant is refunded in full, automatically.
- **Cancellation by the Operator:** The Operator may suspend an Experience Host or a Fishing Experience that does not meet the Experience Host Standards and cancel its upcoming dates. The Booking Fee of every participant is then refunded in full, automatically.
- **Late or mismatched payments:** A payment that reaches us after the hold has expired, or that does not match the booking, does not book a place and is refunded in full.
- **Your commitments as a participant:** At checkout you confirm that every participant meets the age requirement, holds any licence the experience requires, and accepts the Experience Host Standards under which the experience runs. On the day, every participant follows the Experience Host's safety instructions and the rules of the water.
- **Reviews:** A participant of a completed date they paid for may review it once, under the [**Review Policy**](https://lakebooking.com/legal/review-policy).
- **Liability:** The disclaimers of section 2 apply to Fishing Experiences. The Operator does not guarantee catches, the weather, the conditions of the water or the outcome of the day, and it is the Experience Host who holds the permits, registrations and insurance their activity requires.

### 6. Obligations of the Parties

- **Fishermen** agree to provide accurate and complete information during checkout (First Name, Last Name, Full Address), which is legally required for invoicing, and to respect the internal rules of the lake they have booked.
- **Owners** assume full responsibility for declaring their income to ANAF for all amounts collected on-site and for holding all necessary legal permits to operate the fishing venue.
- **Experience Hosts** run every Fishing Experience as listed and under the Experience Host Standards, and assume full responsibility for declaring the income they collect on the day and for the permits, registrations and insurance their activity requires.

### 7. Disputes and Governing Law

- **Disputes with a Host or an Experience Host.** Your contract for the fishing session or the experience is with the Host or the Experience Host, not with the Operator. Write to them first, through the booking's message thread. If you cannot agree, the Operator can mediate as described in the [**Refund Policy**](https://lakebooking.com/legal/refund-policy). The contract with the Host is governed by the law of the country where the lake is (or where the experience takes place), without prejudice to the consumer protections described below.
- **Limitation of Liability.** The Operator is not liable for the services Hosts and Experience Hosts provide at the venue, for fish stock, catches, weather or water conditions, or for the acts or omissions of Hosts, Experience Hosts or other anglers. Nothing in these Terms limits or excludes the Operator's liability for death or personal injury caused by its negligence, for fraud, for damage caused intentionally or through gross negligence, or any other liability that cannot be limited or excluded under the law that applies to you.
- **Governing law.** These Terms are governed by Romanian law. If you are a consumer and live in another country of the European Union or in the United Kingdom, you also keep the protection of the mandatory consumer protection rules of the country where you live, which cannot be set aside by agreement. Nothing in these Terms affects those rights.
- **Courts.** If you are a consumer, you may bring proceedings against the Operator in the courts of Romania or in the courts of the place where you live, and the Operator may bring proceedings against you only in the courts of the country where you live. If you are not a consumer, disputes go to the competent courts of Romania.
- **Complaints and out-of-court resolution.** Write to us first at [**contact@lakebooking.com**](mailto:contact@lakebooking.com). If you are a consumer in Romania, you can also take the dispute to an alternative dispute resolution body through the ANPC's SAL platform at [**reclamatiisal.anpc.ro**](https://reclamatiisal.anpc.ro/). If you live in another country of the European Union, the European Consumer Centre of your country can help you with a cross-border complaint, free of charge.

### 8. Reporting Illegal Content and How We Moderate

- **Who can report:** Anyone, with or without an account, can tell us about content on the Platform that they believe is illegal or breaks these Terms or our policies, whether a lake listing, a Fishing Experience, a review, a catch report or its photos, or a message they received. Use the Report link next to the content, or the [**report form**](https://lakebooking.com/report-content). We confirm every report that comes with an email address, and tell the person who reported it what we decided.
- **What a report needs:** The exact link to the content, why you believe it is illegal or against our rules, your name and email (not required when you report child sexual abuse material or intimate images shared without consent), and your statement that you report in good faith.
- **How we decide:** A person on our team reviews every report; we do not use automated tools to take decisions. Urgent reports (a threat to someone's life or safety, a child in danger, intimate images shared without consent) get a first look within a day, the others within a week. Where we suspect a criminal offence that threatens someone's life or safety, we inform the competent authorities.
- **What we may do:** Leave the content as it is; remove it, or the part that breaks the law or our rules (a photo, for example); hide it from the public site while its author keeps it; or suspend a listing, with or without cancelling the bookings or dates still ahead, whose booking fees are then refunded. In an urgent case we may restrict content temporarily while we finish reviewing it.
- **Statement of reasons:** When we restrict your content, we tell you, by email and in your account, what we did, where and for how long, the facts, whether a report set it off, the law or the rule it rests on, and how you can challenge it.
- **Challenging a decision:** You can ask us to review a decision within six months of it, from the statement in your account or, if you reported the content, from the link in our email. You can also complain to ANCOM, Romania's Digital Services Coordinator, or go to court.
- **Point of contact:** Users, authorities and rights holders reach us at [**contact@lakebooking.com**](mailto:contact@lakebooking.com), in Romanian or English. This is our single point of contact under Regulation (EU) 2022/2065 (the Digital Services Act).
