These terms govern the relationship between LakeBooking and the Lake Owners/Hosts listing their venues on our platform.

This Host Agreement ("Agreement") is concluded between LakeBooking S.R.L. (registered in Romania, CUI 55420249, Trade Register no. J2026049620005, registered office: Strada Dr. Leonte Anastasievici, Nr. 9, Camera 2, Etaj 1, Ap. 2, Sector 5, Bucharest, 050464) (the "Operator") and any legal entity, sole trader (PFA, II, IF), freelancer, or individual owner who registers a host account and lists a fishing lake or swim on lakebooking.com (the "Host" or "Owner").

By publishing a listing on the Platform, the Host accepts and agrees to be legally bound by this Agreement.

  • pure Intermediary: LakeBooking acts exclusively as a technological intermediary (marketplace facilitator) connecting anglers with hosts. LakeBooking does not own, manage, or operate the fishing lakes, swims, or services listed by the Host.
  • No Employment: This Agreement does not create any employment, partnership, joint venture, or franchise relationship between the Operator and the Host. The Host operates as an independent contractor under their own authority.

2. Host Licensing, Safety, and Claims

  • Compliance and Permits: The Host represents and warrants that they hold all valid national and local permits, licenses, authorizations, registrations, or approvals required by Romanian and European law for the Host's specific activities, to operate the fishing venue and receive paying customers.
  • Safety Obligations: The Host is solely responsible for maintaining safe premises and complying with all applicable health, safety, environmental, water hygiene, and access regulations.
  • Venue and Services Liability: The Host bears sole responsibility for all representations made in listings and for the services provided at the venue. The Operator assumes zero liability for regulatory breaches, safety failures, or representations made by the Host.
  • Niche-Specific Disclaimer: The Host acknowledges that the Operator does not guarantee fish stock levels, fish species availability, catch success, weather conditions, water conditions, accessibility, lake quality, or general safety of the venue.

3. Financial Flow, Platform Fees, and Invoicing

  • Platform Service Fee: In exchange for the search, listing, and booking technology provided by the Operator, a Platform Service Fee (currently 10% of the booking value, subject to modification by the Operator upon prior notice to the Host) is charged online.
  • No Payout Flow: The Host acknowledges and agrees that the Platform Service Fee is collected by the Operator directly from the angler. In settlement of this technology service:
    • The Operator retains the online fee as its compensation.
    • The Host is entitled to collect the remaining balance (currently 90% of the booking value) directly from the angler on-site (via cash, card, or other payment methods accepted at the fishery).
    • No funds will flow from the Operator's bank accounts to the Host's bank accounts.
  • Fiscal Invoicing:
    • The Operator will issue a fiscal invoice for the Platform Service Fee directly to the angler (which will be reported to the RO e-Factura system).
    • The Host holds the exclusive legal obligation to issue a fiscal receipt (bon fiscal) or invoice to the angler for the remaining balance collected on-site, in compliance with Romanian fiscal laws. The Host warrants that they will declare all such earnings to the competent tax authorities (ANAF).

4. EU DAC7 Tax Reporting Compliance

  • Data Provision and Reporting: Where required by applicable law, including DAC7 reporting obligations, the Host must provide the Operator with complete and accurate tax identification details (CUI, CNP, VAT number, legal address, and IBAN) upon request. The Operator may collect, verify, retain, and report relevant Host information and total facilitated booking values to competent authorities (such as ANAF) as legally required.

5. GDPR and Data Protection

  • Independent Data Controllers: Once the Operator shares the booking angler's personal details (Name, Surname, Phone number) with the Host to facilitate the booking, the Host becomes an independent Data Controller of that personal data under GDPR.
  • Strict Purpose Limitation: The Host agrees to process the angler's personal data solely to confirm and fulfill the specific booking. The Host is strictly prohibited from:
    • Using the angler's contact details for unsolicited marketing communications (emails, SMS, phone calls) without obtaining separate, explicit consent.
    • Selling or sharing the data with any third parties.
  • Security: The Host must implement appropriate technical and organizational measures to protect angler personal data from unauthorized access or leakage.

6. Listings, Pricing, Calendar and Suspension Rights

  • Listing Responsibility: The Host is responsible for maintaining accurate pricing, availability, capacity, and booking restrictions.
  • Calendar Management: The Host must keep their calendar up-to-date. If a double-booking occurs due to Host calendar mismanagement, it is treated as a Host-initiated cancellation.
  • Honoring Bookings: The Host must honor all bookings confirmed by the Platform. If the Host cancels a booking (except in documented cases of force majeure, extreme weather, or lake closures), the Operator will refund 100% of the Platform Service Fee to the angler, and the Host's account standing and search ranking may be penalized.
  • Right to Suspend or Remove Hosts: The Operator may refuse, suspend, restrict, delist, or permanently terminate any Host account or listing at its sole discretion, including where the Host:
    • Violates this Agreement or Platform policies.
    • Receives repeated complaints or excessive negative reviews.
    • Provides inaccurate, misleading, or incomplete listing information.
    • Breaches applicable law.
    • Harms the reputation of the Platform.

7. Chargebacks and Indemnification

  • Chargeback Liability: If an angler initiates a card chargeback via Stripe/bank for the online fee, and the chargeback is decided in the angler's favor due to Host fault (e.g., the swim was unavailable, the Host canceled the session, or the venue was closed), the Host agrees to indemnify and reimburse the Operator for the amount of the refunded fee plus any administrative chargeback fees.

8. Reviews, Content and Intellectual Property

  • Customer Reviews: The Host acknowledges and agrees that customers may leave reviews and ratings on the Platform regarding their venue and services.
  • Review Moderation: The Operator may remove reviews that violate Platform policies, in accordance with the Review & Content Policy.
  • Review Challenges: Hosts may challenge reviews through moderation appeal procedures established by the Operator.
  • Host Content License: By uploading photos, logos, descriptions, or videos to the listing, the Host grants the Operator a non-exclusive, worldwide, royalty-free license to display and distribute that content to promote the platform.
  • Accuracy: The Host warrants that all listing information is accurate and does not violate any third-party copyrights or trademarks.

9. Limitation of Liability

  • Limitation of Liability: To the maximum extent permitted by law, the Operator shall not be liable for lost profits, business interruption, property damage, personal injury, fish mortality, environmental incidents, customer disputes, or any actions or omissions of Hosts or anglers.

10. Transfer of a Listing to Another Host

  • Right to Request a Transfer: A Host may request to transfer one of their lake listings, together with everything attached to it (swims, packages, media, calendar, and existing bookings), to another person who already holds a registered host account with a verified email address.
  • Operator Approval and Recipient Acceptance: A transfer takes effect only after (i) the Operator reviews and approves the request, and (ii) the receiving Host expressly accepts it. The Operator may refuse or reverse a transfer at its sole discretion, including where the recipient is not adequately identified or verified, or where the transfer appears intended to circumvent a suspension, penalty, or these terms.
  • Effect on the Listing: Upon completion, the listing is re-submitted for verification and its bookings are paused until the receiving Host completes their own verification and re-enables bookings. The receiving Host becomes the sole party responsible for the listing from that moment.
  • Existing Bookings and Liabilities: Confirmed and upcoming bookings transfer to the receiving Host, who assumes full responsibility for honoring, servicing, and (where applicable) refunding them. The transferring Host remains responsible for their own obligations (including fiscal and DAC7 obligations) for the period during which they operated the listing; the receiving Host is responsible from the moment the transfer completes.
  • Tax and Reporting Attribution: Each Host is responsible for declaring and reporting their own earnings to the competent authorities (ANAF) for the period in which they operated the listing. The Operator may record, retain, and report Host information and facilitated booking values as required by law, including DAC7.
  • No Fee: The Operator does not currently charge a fee for processing a listing transfer.

11. Governing Law and Disputes

  • This Agreement is governed by Romanian law. Any disputes arising from this Agreement that cannot be settled amicably will be submitted to the competent courts of law in the municipality where the Operator is registered.
